In a victory for medical marijuana patients, the California Supreme Court on May 23 denied review of an important dispensary case out of Los Angeles. Rejecting calls from State Attorney General Kamala Harris and law enforcement to review a 2nd District Court of Appeal ruling in People v. Colvin, the high court upheld certain protections for patients and providers. The Attorney General had argued that some undefined percentage of patients were legally required to participate in the operation of the medical marijuana dispensaries in order to obtain medication from them.

Smoking cannabis can help relieve spasticity (muscle tightness) and pain in people who suffer from multiple sclerosis, a new study suggests. Study leader Dr. Jody Corey-Bloom, director of the US San Diego Multiple Sclerosis Center, looked at 30 multiple sclerosis patients with muscle tightness who weren't helped by conventional medicines, and discovered they found relief from smoking cannabis. "Smoking pot reduces the spasticity by about a third compared to patients on placebo," she said. Those who smoked cannabis also had a 50% decrease in pain scores. The study is published in the May 14 issue of the Canadian Medical Association Journal. (Huffington Post, Health Day, May 14)

Federal agents from the DEA and IRS, backed up with Santa Barbara police, served search warrants at a medical marijuana dispensary and a grow house on May 2 and 3. No arrests were made, but search warrants were executed at the Pacific Coast Collective dispensary and, the next morning, at 305 E. Haley St., which was named as a grow house. Agents and detectives also searched the residences of PCC operator Charles Jeff Restivo in Carpinteria, who is already facing local felony charges related to the dispensary; and Steven Kessler in Santa Barbara, who was said to operate the cultivation site.

A May 5 report in the Sacramento Bee portrays an Emerald Triangle hard-hit by the federal crackdown on medical marijuana in California. Cultivators who sought legitimacy through the medical market are fleeing to the black market, leading to a glut—which is now ironically hurting the remnant medicinal market. With cheap weed getting dumped in the college town of Arcata, some local dispensaries say business is down 75%. The price of top-line bud has dropped from around $5,000 to under $1,000. "Last I heard, a pound of marijuana is $800 for outdoor grown," gloated Mendocino County Sheriff Tom Allman. "That's plummeting. You might do better with tomatoes."

A UC San Diego student left in a federal holding cell for days without food and water has filed a $20 million lawsuit against the government. Daniel Chong, 23, was picked up in a Drug Enforcement Administration (DEA) raid April 21. After questioning him, agents told him that he would not be charged and to wait in the holding cell until they finished the paperwork to release him. He spent four days alone in the cell, apparently forgotten.

US House Minority Leader Nancy Pelosi (D-CA) issued a statement May 2 condemning the escalated attacks on state-compliant medical marijuana businesses in her state. Responding to the recent federal crackdown on California dispensaries, Pelosi said she has "long supported" and will "continue to strongly support" efforts to "advocate federal policies that recognize the scientific evidence and clinical research demonstrating the medical benefits of medicinal marijuana, that respects the wishes of the states in providing relief to ill individuals, and that prevents the federal government from acting to harm the safe access of medicinal marijuana provided under state law."*

Police arrested 11 suspects and seized 2,500 cannabis plants in a raid of a "heavily fortified" warehouse in East Oakland, authorities announced April 26. Oakland police, including SWAT team members, converged on the warehouse on the 900 block of 89th Ave., which was rigged for video surveillance and had doors bolstered with reinforced steel. In addition to the plants, officers seized 50 pounds of "dried, processed" cannabis; $40,000 in cash; four handguns; a shotgun; two assault rifles; two sets of body armor; and a "ballistics face mask" and helmets, the police department said. "This is one of the largest marijuana recoveries in recent years in the city of Oakland," said Assistant Chief Anthony Toribio. "This was a well-organized marijuana factory." The San Francisco Democratic Party adopted a resolution April 25 demanding that President Barack Obama, Attorney General Eric Holder and US Attorney Melinda Haag "cease all Federal actions in San Francisco immediately, respect State and local laws, and stop the closure of City-permitted medical cannabis facilities." The resolution was co-sponsored by 21 members of the party's San Francisco County Central Committee (DCCC) including its author Gabriel Haaland, Assembly member Tom Ammiano, State Senator Leland Yee, Supervisor David Campos, Supervisor David Chiu, former State Senator Carole Migden, and former Supervisor Aaron Peskin.
