British Columbia high court deals blow to mandatory minimums

CanadaThe Appeal Court of British Columbia, the province's highest, on Dec. 28 upheld a lower court ruling that the minimum two-year prison term for marijuana possession "for purpose of trafficking" under Canada's Controlled Drugs & Substances Act is unconstitutional. Justice Sunni Stromberg-Stein dismissed the Crown's appeal of a 10-month sentence imposed when Phillip Francis McGee pleaded guilty after the Royal Canadian Mounted Police raided his home in Surrey.

CanadaAmid the controversies about federal versus provincial control of the cannabis biz as Canada prepares for legalization, another jurisdictional issue has emerged. At the annual meeting of the Assembly of First Nations (AFN) in Ottawa Dec. 6, leaders of Canada's indigenous peoples demanded the right to set the laws that will oversee cannabis within their own territories.

CanadaPretty ironic timing. Just as Canada is moving toward legal cannabis, dispensaries are coming under more legal pressure and being forced to shut down—most recently in Toronto. On Dec. 7, the city's Cannabis Culture outlet—which had been targeted in a police raid back in March—finally shut its doors, and seemingly this time for good. The Ottawa Citizen reports that police arrived at the popular Cannabis Culture dispensary on Bank Street with a bailiff, who changed the locks and posted a notice on the door saying the lease was being terminated.

$30 billion global cannabis market foreseen

Shadow WatchYou know the times they are a-changing when Forbes magazine runs a headline predicting that the international market for cannabis will hit $31.4 billion within the next four years. This projection is based on  a new report from the Brightfield Group, a cannabis market research firm based in Chicago. Currently, the global market is estimated to be worth $7.7 billion, but a compound annual growth rate of 60% is foreseen as countries around the world liberalize their marijuana laws.

CanadaAs Canada prepares to legalize cannabis next year, the country has seen several recent conferences and expositions on how industry and society will manage the transition. The latest, the Grow Up Conference and Expo, opens Oct. 6 at the Niagara Falls Scotiabank Convention Centre in Ontario, and will feature over 100 speakers from a variety of specialties, including doctors and lawyers—with a focus on cultivation.

Hong Kong cannabis interceptions soaring

Hong KongCannabis seizures are rapidly escalating in Hong Kong—whether due to greater quantities on the market or stepped-up enforcement, or both. The city's South China Morning Post reports June 19 on a haul of 35 kilos in 136 baggies ready for sale, uncovered in a vehicle during a police raid on a car park. Three were arrested. Police estimated the street value of the load at HK$10 million (about US$1.3 million). As recently as May 27, the SCMP reported a police raid on an industrial building in the city's Tai Po district that netted 110 kilos, worth HK$19 million. (Obviously, the math is not adding up here, raising questions about how the Hong Kong cops arrive at their estimates.)

Venture capital eyes legal cannabis sector —warily

leafIt is certainly a sign of the times that a partnership of major California media—led by Bay Area News Group, owner of the San Jose Mercury News—has launched a website entitled The Cannifornian, "Covering the Golden State of Cannabis." That means it's dedicated to reportage on the fast-growing cannabis sector in post-legalization California. An April 25 offering, "Venture capital investors betting big on cannabis," notes that financial consultancy firm New Frontier Data is predicting nationwide legal cannabis sales will balloon to more than $24 billion by 2025.

Canada: long-awaited cannabis legalization bill introduced

CanadaPrime Minister Justin Trudeau introduced legislation to legalize the recreational use of cannabis in Canada April 13, following through on a campaign pledge and ending a long wait by advocates and entrepreneurs. The new law would allow adults 18 and over to possess or share up to 30 grams of dried herbaceous cannabis, and to purchase cannabis or cannabis oil from retailers, to be regulated at the provincial level. Canadians would also be allowed to grow up to four plants per residence for personal use, and to prepare legal cannabis products at home. Cannabis-infused edibles are to be available for sale after the regulatory framework is developed and brought into force.
